The $10,000 Treasure Hunt (the “Promotion”) is sponsored by Explorica, Inc. (the “Promotion Sponsor”). The Promotion Sponsor will operate a series of ten contests with a treasure hunt component (each a “Contest”).  Each Contest will be associated with one of ten educational travel tours organized by the Promotion Sponsor, as set forth in Section 1 below (each, a “Treasure Hunt Tour”).  Each Contest begins on the first day any member of a participating tour group (each a “Tour Group”) is provided with access to its individualized webpage (the “Tour Webpage”) and ends on the last date of the applicable Treasure Hunt Tour (the “Contest End Date”) (such period referred to herein as the “Contest Period”). 

1. HOW TO ENTER:  Each Tour Group leader (each a “Group Leader”) may reserve one of the ten Treasure Hunt Tours described below by visiting the Promotion Sponsor’s website to select his or her desired Treasure Hunt Tour.  Please visit www.explorica.com/treasurehunt for more details.  Tour Groups must meet the eligibility requirements set forth in Section 4 below by enrolling a minimum number of full-paying members (each such member a “Tour Participant”) one hundred and twenty (120) days prior to the Tour Group’s date of departure.  Tour Participants must themselves meet the eligibility requirements set forth in Section 4 below.  Tour Participants may enroll in a Treasure Hunt Tour by visiting the Tour Sponsor’s website.  Once a Tour Participant enrolls, the Tour Participant will be notified via email and given access to his or her Tour Group’s Tour Webpage.  Participation in a Treasure Hunt Tour and the related Contest is first come first serve and is voluntary.  Tour Participants may not participate in more than one Contest.  The Treasure Hunt Tours are scheduled to depart and return on the following dates:

2. PRIZE:  Each Private Tour Group (as defined in Section 4 below) is eligible to win $10,000 in cash (a “$10,000 Prize”) and each Consolidated Tour Group (as defined in Section 4 below) is eligible to win a pro rata share of the $10,000 in cash based on the number of Consolidated Tour Groups participating in the applicable Treasure Hunt Tour (a “Pro Rata Prize”, and each such $10,000 Prize and Pro Rata Prize shall be considered a “Prize”).  Any Prize won shall be issued to the Designated School (as defined below) and NOT to the winning Tour Group.  Only one Prize may be awarded per Tour Group.  The maximum amount of all Prizes which may be awarded is $100,000.  The actual value of Prizes to be awarded depends on the outcome of each Contest.

Each Tour Group leader (each a “Group Leader”) must designate a school (each, a “Designated School”) to receive his or her Tour Group’s Prize, if any, one hundred and twenty (120) days prior to the Tour Group’s date of departure. The Group Leader must designate a school that fairly represents the interests of the Tour Participants.  Any Prize won by a Tour Group will be issued directly to the Designated School by the Promotion Sponsor.  For the purposes of this Promotion, a “school” means any educational institution, including, without limitation: colleges, universities, primary and secondary schools.  Neither a winning Tour Group nor its Tour Participants (“Winner(s)”) shall have any right to any portion of the Prize. The Winners will be solely responsible for all other expenses not specifically set forth herein.  The Promotion Sponsor reserves the right to substitute prizes of equal or greater value.  No other substitution or transfer of prizes permitted.  The Promotion Sponsor is responsible only for Prize delivery.  Following the final Contest End Date, the Promotion Sponsor will contact the Designated Schools designated by the Group Leaders of the winning Tour Groups. Any and all taxes on any portion of the Prize, including income and/or sales taxes, are the sole responsibility of such Designated Schools.

3. HOW TO WIN:  Each Tour Group must earn a cumulative 10,000 points during the applicable Contest Period to win the Prize.  Points shall be awarded to a Tour Group upon the Tour Group’s successful completion of the objectives provided to the Tour Group, as determined by the Promotion Sponsor in its sole discretion.  Some objectives will be provided on the Tour Group’s Webpage while other objectives will be circulated to the Tour Group during the Treasure Hunt Tour.  Points may be awarded to Tour Participants or the Tour Group itself.  Points may be earned by Tour Participants prior to the departure date by successfully completing the pre-tour clues or objectives.  Up to 5,000 points may be earned prior to the Tour Group’s date of departure.  Please visit www.explorica.com/treasurehunt to learn how to earn pre-tour points.  Points earned by Tour Participants will be credited towards his or her Tour Group’s point balance.  Tour Participants can only earn points once the Tour Participant has enrolled in a Treasure Hunt Tour and has satisfied the participant eligibility requirements set forth in Section 4 below..  Points earned have no cash value. 

4. ELIGIBILITY

Tour Group Eligibility.  To be eligible to participate in the Promotion, a Tour Group must be either a Private Tour Group or a Consolidated Tour Group.  A “Private Tour Group” is a Tour Group consisting of at least thirty-five (35) full paying Tour Participants.  A “Consolidated Tour Group” is a Tour Group which is participating in a Treasure Hunt Tour with one or more Consolidated Tour Group(s) meeting these same eligibility requirements provided, however , that the inclusion of a Consolidated Tour Group in a Treasure Hunt Tour is subject to the Promotion Sponsor’s approval in the Promotion Sponsor’s sole discretion, and the Promotion Sponsor reserves the right to require that a given Consolidated Tour Group consists of a minimum number of full paying Tour Participants, in the Promotion Sponsor’s sole discretion.  The total number of Tour Participants participating in any Treasure Hunt Tour may not exceed fifty (50) total travelers.

Participant Eligibility.  The Promotion is only open to legal residents of the United States who are at least ten (10) years of age at the time of departure.  Entries are limited to individuals only; commercial enterprises and business entities are not eligible.  By participating in the Promotion, each Tour Participant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Promotion Sponsor and warrants that she/he is eligible to participate in the Promotion.  Employees, independent contractors, officers, and directors of the Promotion Sponsor, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and their immediate family members and persons living in the same household, are not eligible to participate in the Promotion.  THE PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations.

5. SELECTION OF WINNERS:  On each Contest End Date the Promotion Sponsor will determine in its sole discretion whether the applicable Tour Group has accumulated the requisite number of points to be designated a Winner. 

The Winners and the Designated School will be notified by mail, telephone or email using the information provided when the Tour Participant entered the Contest, within 5 days of the applicable Contest End Date.  In the event the Designated School does not accept the Prize, the Designated School is ineligible, or the Prize or Prize notification is not deliverable an alternate school may be selected by the Group Leader.  The Promotion Sponsor is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify any Winner or Designated School.  The Winners agree to Promotion Sponsor’s use of their name, address, likeness, and/or Prize information for promotional purposes in any medium without additional compensation to the extent permitted by law.  Where lawful, the Winners may be required to sign and return an Affidavit of Eligibility, Release of Liability, and Publicity Release.

6. CONDITIONS:  The Promotion Sponsor, and its agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors, are not responsible for, shall not be liable for, and hereby disclaim all liability arising from or relating to: (i) any condition caused by events beyond the control of the Promotion Sponsor; (ii) any injuries, losses, or damages of any kind arising in connection with or as a result of the Prize, or any portion thereof that may have been awarded, or acceptance, possession, or use of the Prize, or any portion thereof that may have been awarded, or from participation in the Contest; or (iii) any printing or typographical errors in any materials associated with the Contest.  The Promotion Sponsor reserves the right, in its sole discretion, to suspend, modify or cancel the Contest should any unauthorized human intervention or other causes beyond the Promotion Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Contest. The Promotion Sponsor also reserves the right, in its sole discretion, to disqualify any Tour Participant and deduct any points won by him or her from the Tour Group’s point balance for any actions which the Promotion Sponsor determines to be cheating, fraudulent or deceptive in any manner, in the Promotion Sponsor’s sole discretion.  By participating in the Promotion, Tour Participants agree to release, discharge and hold harmless the Promotion Sponsor, and its agents, directors, officers, shareholders, employees, insurers, servants, parents, divisions, subsidiaries, affiliates, predecessors, successors, representatives, advertising, promotion, and fulfillment agencies, and legal advisors, and all others associated with the development and execution of the Promotion, from any and all losses, damages, rights, claims and actions of any kind arising out of or relating to the Promotion, participation in the Promotion, any Prize, or any portion thereof that may have been awarded, and/or acceptance, possession, use or misuse of any Prize, or any portion thereof that may have been awarded, including but not limited to statutory and common law claims for misappropriation or participant’s right of publicity.  This Promotion shall be governed by Massachusetts law.  By participating in this Promotion, Tour Participants agree that Massachusetts courts shall have jurisdiction over any dispute or litigation arising from or relating to this Promotion and that venue shall be only in Boston, Massachusetts.

8. NOTICE:  The Promotion Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Promotion in violation of these Official Rules and/or criminal and/or civil law.
